Professional Marketplace Terms

Effective from: 24 May 2026

These Professional Marketplace Terms apply if Monitrax allows users to find, contact, request quotes from, message, book, or share information with third-party professionals through Monitrax.

They form part of Monitrax's Terms of Service.

1. Independent professionals

Professionals listed, introduced, displayed, or contacted through Monitrax are independent third parties unless we expressly state otherwise.

They may include accountants, tax agents, financial advisers, mortgage brokers, lawyers, buyer's agents, conveyancers, consultants, or other service providers.

Monitrax does not employ, supervise, control, or manage independent professionals.

2. No recommendation or endorsement

A listing, profile, badge, search result, ranking, rating, placement, introduction, or message in Monitrax is not a recommendation or endorsement.

Monitrax does not assess whether a professional is suitable for you.

You are responsible for deciding whether to contact, engage, or rely on a professional.

You should check the professional's qualifications, licence, registration, insurance, experience, fees, scope of work, and terms before engaging them.

3. Professional advice is between you and the professional

Any advice or service provided by a professional is provided by that professional, not Monitrax.

Your engagement is between you and the professional.

Monitrax is not responsible for professional advice, professional services, fees, delays, negligence, misconduct, omissions, or outcomes, except to the extent required by law.

4. Data sharing with professionals

We will not share your personal financial data with a professional unless:

  • you choose to send it;
  • you consent to the disclosure;
  • the disclosure is required or authorised by law.

Before you submit a request or share information, you should check what information will be sent.

You should not share information you do not want the professional to receive.

CDR data will only be disclosed to professionals where permitted by CDR law and covered by valid consent or another lawful basis.

5. Referral fees and commercial arrangements

Monitrax may receive referral fees, marketplace fees, commissions, sponsorship payments, subscription fees, listing fees, lead fees, or other benefits from professionals.

If such arrangements apply to a feature, we will disclose this clearly before you use the relevant feature.

A paid placement or commercial relationship must not be treated as a recommendation that a professional is suitable for you.

6. Professional obligations

Professionals are responsible for maintaining any licences, registrations, authorisations, insurance, professional memberships, and qualifications required for their services.

Professionals must not use Monitrax to provide services they are not authorised or qualified to provide.

Professionals must comply with applicable laws, professional standards, privacy obligations, and consumer law obligations.

7. User obligations

When using marketplace features, you must:

  • provide accurate information;
  • not impersonate another person;
  • not submit false, misleading, abusive, unlawful, or harmful content;
  • not upload unnecessary sensitive information;
  • not use the marketplace for spam, harassment, scams, or unlawful conduct;
  • deal with professionals respectfully and lawfully.

8. Reviews and ratings

If Monitrax allows reviews or ratings, you must ensure your review is honest, based on your own experience, and not misleading, defamatory, abusive, or unlawful.

We may remove, moderate, or restrict reviews where we reasonably believe they breach these terms, the law, or platform integrity requirements.

9. Disputes with professionals

If you have a dispute with a professional, you should first raise it with that professional.

Depending on the professional's role, you may also have rights to complain to a professional body, regulator, external dispute resolution scheme, tribunal, or court.

Monitrax may assist with platform-related issues but is not required to resolve disputes about professional advice or services.

10. Marketplace availability

Marketplace features may be added, changed, suspended, or removed at any time.

We may remove or restrict a professional profile if we reasonably believe there is a breach, risk, complaint, legal issue, or platform integrity concern.
